As for Apple, they have not issued any official statement yet.

On December 26, 2023, Apple Watch Series 9 and Apple Watch Ultra 2 were temporarily suspended from sale through Apple's official channels. However, this didn't last long as the US Appeals Court has temporarily allowed Apple to continue selling its latest smartwatches, while US Customs and Border Protection determines whether the changes made by Apple are reasonable and no longer raise concerns about intellectual property rights issues with Masimo.

9to5Mac revealed a statement from Masimo Corporation's legal team, indicating that all three parties, Masimo, Apple, and the US Customs, have agreed on measures to remove the blood oxygen level monitoring feature from the latest generation of Apple Watches.

According to Bloomberg, software updates disabling the SpO2 feature have been dispatched to Apple Stores nationwide, awaiting the corporation's directive to resume sales.

At present, both the Apple Watch Series 9 and Apple Watch Ultra 2 retain the ability to measure SpO2. However, it remains unclear whether the new watchOS update will deactivate this feature or if previously sold products will continue to operate with full functionality despite the effective ban.
