According to Article 13 of the Citizenship Law, birth registration is mandatory. Parents are required to register the birth of their child within 60 days from the date of birth. If parents are unable to do so, other relatives or organizations and individuals caring for the child will be responsible.

I. Birth Certificate Procedures for Your Child
When getting a birth certificate for your baby, you can be the father, mother, grandparents, other relatives, or organizations caring for the child. Follow these steps:
Step 1: The person registering the birth certificate needs to prepare the following documents:
- Birth certificate: This certificate is issued by the Hospital or Healthcare Facility where the child was born. If the child was not born in a healthcare facility, the birth certificate will be replaced by a confirmation document from a witness. If there is no witness, the person registering the birth will need to make a sworn statement regarding the birth.
- Birth certificate of the child.
- Marriage certificate of the parents if applicable. Not required if marital status is already known by the authorities.
- Original and photocopy of parent's ID card/passport.
- Complete the birth registration form. You can obtain it at the relevant office or online.

Step 2: Submit the documents at the People's Committee of the commune where the mother has her permanent residence.
Applies to both the mother and father of the child who are Vietnamese citizens residing in the country.
- If the mother has her permanent residence registered but currently resides and works elsewhere under temporary residence, the Commune People's Committee where she has temporary residence has the authority to register the birth of the baby.
- If the baby's mother does not have a registered permanent residence, the Commune People's Committee where the mother has her temporary residence will proceed with the birth registration. If the mother does not have temporary or permanent residence registration, the Commune People's Committee where the father has his permanent residence will proceed with the birth registration. If neither the father nor the mother's residence can be determined, the registration should be submitted to the Commune People's Committee where the child is currently living.
* Other specific cases
- Registration of abandoned children is conducted at the Commune People's Committee where the caregiver resides or where the temporary residence of the organization currently caring for them is located.
- In cases of unknown paternity, the father's section in the birth registration form will be left blank. If someone accepts the child at the time of registration, the Commune People's Committee needs to coordinate the child acceptance and birth registration.
- For children born in Vietnam with Vietnamese parents residing abroad, documents should be submitted to the Commune People's Committee where the mother or father resides during their time in Vietnam.
- For children born in Vietnam, with one Vietnamese parent residing in the country and the other Vietnamese parent residing abroad, documents should be submitted to the Commune People's Committee where the Vietnamese parent residing in the country is currently living.
Step 3: The Commune People's Committee receives the birth registration documents and issues the birth certificate.
- Upon receipt, the Justice - Civil status officer will check the documents and enter them into the birth registration book, the original Birth Certificate. Then, it will be presented to the Chairman of the Commune People's Committee for signature on the original Birth Certificate.
- The birth certificate is issued in only 1 original copy, while the photocopy depends on the request of the registrant.
The processing time for issuing the birth certificate is only 1 day. The collection time for the birth certificate is from Monday to Saturday.
* Note: If the birth registration exceeds the specified time limit (i.e., more than 60 days from the date of birth), a warning or a fine ranging from 50,000 - 1,000,000 VND will be imposed.
II. Procedure for registering household registration for children
Similar to the birth registration procedure in 2019, the registrant must be the father, mother, family representative, grandparents, caregivers, or close relatives of the child.
Step 1: The registrant for household registration needs to prepare the following documents:
- Copy and photocopy of the child's birth certificate.
- Marriage certificate of the parents or Divorce decree along with a photocopy.
- Original household registration book of the family.
- Fill in all the information on the household registration and population change form. This form can be obtained at the District Police Station. You can refer to Mytour's guide on filling out the household registration and population change form to ensure accuracy.
Step 2: Submit the documents and the aforementioned form at the District Police Station where the child's father or mother resides.- Copy and photocopy of the child's birth certificate.
- Marriage certificate of the parents or Divorce decree along with a photocopy.
- Original household registration book of the family.
- The officer receiving the documents will check the information recorded in form HK02 and cross-reference it with the documents.
- The officer will provide an appointment slip indicating the time to collect the household registration book. The maximum processing time is 10 days.
- Processing and collection time for household registration: Monday to Saturday.
- Children are registered under either the father's or mother's household. Household registration for children is entirely free of charge. Similar to birth registration, within the 60-day period, those registering household registration for children need to complete the permanent residence registration for the child. Failure to register within 60 days will result in a fine of 100,000 - 200,000 VND.
