According to the Labor Code 2019, workers are entitled to one day off with full pay for New Year's Day every year. In 2022, as New Year's Day falls on the weekend, workers will receive compensatory leave on the following Monday. The total leave duration is 3 consecutive days from January 1, 2022, to January 3, 2022.
Since 2021, Vietnam has a total of 11 official holidays, including the National Day on September 2, which may be extended by one adjacent day as decided by the Government.
If a holiday falls on a weekend, workers are entitled to compensatory leave on the following day.
According to current labor laws, workers who work overtime or at night during holidays and Tet (New Year) are entitled to at least 300% of their regular pay, not including the regular day's pay. According to the proposal, workers may have a continuous break of 9 days, from Saturday (January 29, 2022) until the end of Sunday (February 6, 2022), which includes 5 days of Tet holiday as per the Labor Law and 4 days of regular weekly holidays.
In case non-government employees, the proposal by the Ministry of Labor, Invalids and Social Affairs (MOLISA) specifies that based on actual conditions and the holiday schedule of government employees, employers can arrange Lunar New Year holidays, allowing employees to choose either 1 day off before Tet and 4 days off after Tet, or 2 days off before Tet and 3 days off after Tet.
Additionally, employers must inform employees of the holiday schedule at least 30 days in advance.
With this proposal, the total number of days off during the Lunar New Year of the Tiger (2022) will be 2 days longer than the Lunar New Year of the Buffalo (2021).
Moreover, the proposed Lunar New Year holiday schedule for 2022 does not present 2 options as in recent years. However, with flexible selection while still adhering to the Labor Law, employees' holiday duration for the entire Tet period will be extended to 9 days.
