1. Maternity leave for the husband when participating in social insurance.

• Entitled to 07 days off if the wife undergoes surgery or gives birth before 32 weeks.
• If the wife gives birth to twins, the husband is entitled to 10 days off, and for each additional child born, an extra 03 days off are granted;
• If the wife gives birth to twins or more and undergoes surgery, the husband is entitled to 14 days off. (The maternity leave period will be counted within the first 30 days from the wife's delivery date.)
2. Maternity support entitlement when the husband participates in social insurance.
The husband will receive maternity support equivalent to twice the basic salary for each child born in the month.
Example: Mr. Le Van Tan works at a company, participates in social insurance (SI) and health insurance (HI), while his wife stays at home and doesn't participate in SI. Mrs. Tan has just given birth, underwent surgery. In this case, Mr. Tan will receive maternity benefits as follows:
Mr. Tan will take 7 days of maternity leave, counted within the first 30 days from the wife's delivery date. He will receive a one-time support equal to 2 times the basic salary for each child born in the month. At present, in 2016, Mr. Tan will receive maternity support of 2.42 million, calculated as 1.21 million*2 months.
Note regarding maternity support benefits
If a wife gives birth on or after January 1, 2016 when the Social Insurance Law of 2014 officially took effect, and the husband is a worker participating in social insurance, he will be entitled to maternity benefits when his wife gives birth. These provisions are clearly stated in Clause 2, Article 34 of the Social Insurance Law of 2014 and of course, it is in effect at the present time. Many people are unaware of this regulation and may lose their entitlements. It is not necessary for the wife to participate in social insurance in order to receive maternity benefits!
