In this context, development is impossible without opening up to integration.
Vietnam is in the process of renewal, transitioning to a market-oriented socialist economy. Enhancing participation in global and regional economic integration is an important task of the renewal process. However, integration will face challenges. To improve understanding of economic issues, I have chosen the topic: 'Opportunities and Challenges for Vietnamese Enterprises in the Current Process of International Economic Integration.'
7. Introduction to Dissertation on: “Vietnamese Laws Regarding Business Entities”
In the market economy, businesses of all economic sectors have the right to freedom and equality before the law. The freedom and equality of businesses are truly ensured based on a comprehensive legal system, primarily the system of laws regarding business organization.
During the early stages of the economic restructuring process, economic laws in general and laws concerning forms of business organization in particular were built on the foundation of political, economic, and social specificities, serving as situational solutions to address pressing business issues. The number and types of legal documents concerning businesses have rapidly increased. However, the quality of these documents often varies.
With the perspective of building and developing the market economy under the socialist orientation, in recent years, our state has paid great attention to constructing and improving laws regarding businesses. The enactment of the Enterprise Law in 1999 was considered a significant development, introducing new legal concepts in building business laws in Vietnam. However, the current legal system regarding businesses has not yet reached the necessary level of perfection, failing to adequately meet the demands posed by business practices. Legal issues regarding business organization are regulated in various legal documents, revealing many deficiencies in both legal content and legislative techniques. Complexity, contradictions, and overlaps are not uncommon in current business laws. This reality significantly hinders the legal development of business activities, leading to irrational resource allocation and negative impacts on production and business operations, as well as fairness in the business environment.
The Party and the State of Vietnam have the policy of 'Renovation and perfection of the legal framework, removing all obstacles in mechanisms, policies, and administrative procedures to mobilize all resources to create new driving forces for the development of production and business of all economic sectors with various ownership forms...'.
