The United States maintains its stance against granting copyright to AI-generated works.

The US Copyright Office (USCO) has just rejected an application for copyright registration for a painting created by an artificial intelligence system. This marks the second time this office has denied an application from the creator of the system responsible for painting the piece titled 'A Recent Entrance to Paradise,' as seen on the cover.

According to Stephen Thaler, the creator of the AI system known as Creativity Machine, this painting was generated upon the system's own request, therefore possessing all the elements for copyright and human ownership as stipulated by the USCO.

On the contrary, USCO states that current copyright law only protects intellectual labor results created through human intelligence. Therefore, the agency will not register a product created by a machine or machine process without human creative input. They also note that Thaler could not provide evidence that the painting was a result of human creation, and the documents he provided were not persuasive enough for USCO to change current laws. This is similar to many court rulings, including those of the US Supreme Court, which have denied copyright protection for products not created by humans, such as elephant paintings or photos taken by monkeys.

It is known that Thaler has applied for copyright for many of his other products, but most have been rejected on the grounds that the products were not created by humans. Only South Africa allowed one of Thaler's products last year, but it clearly stated that it was an automatically generated work by artificial intelligence.
