Người sử dụng lao động không được trả lương cho người lao động dưới mức lương tối thiểu theo quy định của Pháp luật. Đấy là ý nghĩa của việc ra đời loại lương này. Đây là vấn đề quan trọng ảnh hưởng đến quyền và lợi ích của người lao động. Tuy nhiên thì người lao động thường nhầm lẫn giữa lương tối thiểu chung và lương tối thiểu vùng.

Chúng ta có 4 loại lương tối thiểu được áp dụng tại Việt Nam hiện nay:
1. Lương tối thiểu vùng
According to Decree 157/2018/NĐ-CP (effective from January 1, 2019) which regulates the minimum regional wage applied to employees working in enterprises as follows:
- The amount of 4,180,000 VND/month applies to enterprises operating in region I
- The amount of 3,710,000 VND/month applies to enterprises operating in region II
- For region III, the amount of 3,250,000 VND/month applies
- For region IV, the amount of 2,920,000 VND/month applies
Note: The area applying the minimum regional wage is specified according to the administrative units at district, town, city directly under provincial level. The specific list of provinces under regions I, II, III, IV is mentioned in the appendix accompanying Decree 157/2018/NĐ-CP
At the same time, on July 11, 2019, the National Salary Council finalized the plan to increase the minimum regional wage in 2020 by 5.5% compared to 2019. Specifically, in 2020, the wage will be applied as follows:
- Region I will increase from 4,180,000 VND/month to 4,420,000 VND/month
- Region II will increase from 3,710,000 VND/month to 3,920,000 VND/month
- For region III, it will increase from 3,250,000 VND/month to 3,430,000 VND/month
- And region IV will increase from 2,920,000 VND/month to 3,070,000 VND/month
The increase in 2020 is considered to meet 100% of the minimum living standard of workers. And will be submitted by the National Salary Council to the Government for decision.
2. Base Salary
Base salary, also known as minimum wage.
Decree No. 38/2019/NĐ-CP effective from July 01, 2019. Regulates the base salary applied to officials, civil servants, public employees, beneficiaries of salaries, allowances, and employees working in agencies, organizations, career units State political-social activities and centrally budgeted units supported by the state budget for operations in provinces, centrally-run cities, districts, communes, in special administrative-economic units and armed forces.
Accordingly, the base salary is 1,490,000 VND/month and is used as a basis for calculating:
- Salary levels in salary tables, allowance levels and implementation of other regimes as prescribed by law
- Activity fees, living fees as prescribed by law
- Deductions and regimes enjoyed according to the base salary
Base salary (minimum wage)
As its name suggests, the base salary (minimum wage) is like the foundational salary used to build other salary tables for workers, officials, civil servants, including all those entitled to salaries.
On the other hand, the regional minimum wage is the wage divided according to each region applied to workers under labor contracts in accordance with the law.
3. Minimum Wage for Domestic Workers
According to Article 1, Article 15 of Decree 27/2014/NĐ-CP guiding the 2012 Labor Code on domestic helpers, the minimum wage for domestic helpers shall not be lower than the minimum regional wage mentioned in Part 1.
This wage is agreed upon by the employer and the employee to be appropriate to the interests of both parties.
4. Minimum Industry Wage
Based on Article 3, Article 90 of the 2012 Labor Code, the minimum industry wage is determined through collective bargaining in the industry. It is recorded in the collective labor agreement of the industry.
And this wage shall not be lower than the minimum regional wage mentioned in Part 1.
Note: The above is the minimum wage, the state encourages employers to pay workers as high a wage as possible.
